REGULATIONS OF DOMOTEKA MARKETPLACE SERVICE
dated September 26, 2022.
1. What is covered by these Terms and Conditions?
These Terms and Conditions define the rules for the use and operation of the “Domoteka Marketplace” service (hereinafter also referred to as the “Service”), which constitutes an integral part of the website www.domoteka.pl.
It is advisable to familiarize yourself with these provisions to understand and comply with the terms of use of the Domoteka Marketplace service, as well as to be aware of your rights and the principles governing the operation of the Service.
These Terms and Conditions set out the rules for using the functions and services of the “Domoteka Marketplace” Service by customers of the Domoteka Interior Design Center (hereinafter: “Customer”, “User”).
2. Where can I find the Domoteka Marketplace service and what technical requirements must be met to use it?
By going to the website at: https://domoteka.pl/2-produkty or by going to www.domoteka.pl under the “Browse Products” tab.
In order to use the Domoteka Marketplace Service, it is necessary to have devices that allow the use of Internet resources and an Internet resource browser capable of displaying web pages (it is recommended to use the latest stable versions of the following web browsers: Mozilla Firefox, Safari, Google Chrome or Microsoft Edge), access to an e-mail box will be useful. The Owner of the Service is not responsible for any interference with the operation of data communications links, servers, interfaces, browsers of the User.
3. What is the “Domoteka Marketplace” service?
The “Domoteka Marketplace” service is part of the Domoteka Interior Design Center website – www.domoteka.pl.
The Service was prepared by the owner of Centrum Wyposażenia Wnętrz Domoteka (hereinafter referred to as “Domoteka”)– Retail Park Targówek Warsaw Spółka z ograniczoną odpowiedzialnością with its registered office in Warsaw (address: ul. Jana Pawła II 22, 00-133 Warsaw), entered into the Register of Entrepreneurs of the National Court Register maintained by the District Court for the Capital City of Warsaw. Warsaw, XII Economic Department of the National Court Register under the KRS number 0000628090, NIP 5252669679 (hereinafter: “Owner of the Service“) for the benefit of you, Dear Domoteka Customer.
The purpose of the Service is to provide an opportunity to get acquainted with the offer of the showrooms present in Domoteka, to promote this Center, its tenants and their unique offers.
Without leaving home, you can explore the wide range of products available in the showrooms located in Domoteka. Want to see if you can find the products you need at Domoteka showrooms? Looking for inspiration? Do you want to get acquainted with the offer of recognizable brands, which are not lacking in Domoteka? Take advantage of the Domoteka Marketplace service.
4. What is not the Domoteka Marketplace Service?
Although the Service provides the ability to browse products and sometimes provides access to the online store of a Domoteka showroom tenant, the Domoteka Marketplace Service is not an online store.
You will not make a purchase on this Service for products that you are interested in while browsing. The content posted on the Domoteka Marketplace website does not constitute an offer within the meaning of the Civil Law, in particular an offer for the realization of which the Service Owner bears any responsibility.
The owner of the Service is not the owner of the products displayed on the pages of the Domoteka Martekplace service, nor does he create the product cards displayed on the pages of the Service. The owner of the Website does not offer to sell products that you view on the Website.
For the above reasons, the Owner of the Website is not responsible for the implementation of the sales contract, the visualization of products, the compatibility of visualizations with reality, the delivery of products, their availability in the showroom, the implementation of the order, the content posted on the Website (description, indicated price and other elements of a given product card), etc.
The owner of the Service is not a seller, but only through Domoteka Martekplace allows you to contact the seller of the product you are interested in. You can contact the vendor by using the features of the Service, i.e.:
With regard to the sales contract and the execution of orders, only the tenant of the showroom located in Domoteka, posting an invitation to conclude a sales contract with it on the pages of the Domoteka Marketplace, is responsible. You will always find the vendor’s brand in the product card.
5. What services does the Domoteka Marketplace allow you to provide?
In particular, the Domoteka Marketplace enables:
- Obtaining information about the goods offered by the showrooms in Domoteka,
- going to the websites of the salons, if their owner provides such an option,
- Viewing listings of salon products, including photos and descriptive elements of products arranged in appropriate categories,
- Filtering and sorting products in listings;
- browsing on the product card of products similar to the product clicked by the User;
- Using the product search engine.
6. Who decides on the content of the product sheet?
The owner of the Service ensures the proper, technical functioning of the Service, but the content of individual invitations is shaped by the sellers, i.e. the tenants of the showrooms in Domoteka. They are the ones who choose the products they want to show off. They provide their photos, descriptions, technical parameters, also determine the price.
The tenant of a showroom in Domoteka also decides whether to provide contact information for the showroom or redirect to its online store.
If you would like more information about a particular product, please contact the tenant, who, through Domoteka Marketplace, invites you to purchase their products.
Although the Owner of the Service provides you with his knowledge and assistance, in the above matters he can only indicate that you arrange them directly with the owner of the product.
You are also always welcome to visit Domoteka.
7. How do we process personal data?
The Domoteka Marketplace service is not an online store. You also do not make any payments through Seriwsu. You also do not provide any personal information.
Use of the Website does not entail entrusting the Website Owner with any personal data.
Personal data entrusted to a given tenant of a showroom located in Domoteka during your cooperation with it, in particular when visiting its online store or contacting it, in particular in connection with the execution of an order, shall be the sole responsibility of that tenant of a showroom located in Domoteka.
The tenant of a showroom located in Domoteka does not provide us, through Domoteka Marketplace or otherwise, with any personal information that it obtains from you in connection with your contact. You entrust your personal data directly to the vendor, who is the controller of this data, while the Owner of the Service does not have access to it.

8. Why subscribe to our Newsletter?
By subscribing to the Newsletter you will receive information on the following topics to the e-mail address provided during registration. among others. news and promotions that will appear on the pages of the Domoteka Marketplace Service, as well as about any other relevant events.
Subscribing to the Newsletter is possible on the website of Domoteka Martekplace and consists in providing an e-mail address and clicking the “subscribe” button.
We respect your decisions, so whether you receive our Newsletter will always be entirely up to you.
You must remember that signing up for the Newsletter and providing your e-mail address is free of charge and voluntary. You may also opt out of receiving these messages at any time by submitting a request to remove your email address from the Newsletter subscription or unsubscribing using the link in the body of the message sent as part of the Newsletter service.
The application of the aforementioned. personal data is voluntary and you may withdraw this consent at any time. The personal data provided will be processed by the Site Owner as data controller, who protects and processes the data in accordance with the privacy policy available at https://domoteka.pl/content/7-polityka-prywatnosci-i-cookies.
9. What are your obligations in connection with the use of the Service?
Use of the Service may be made only if you accept the terms of these Regulations.
The use of the Service by Customers is free of charge and voluntary.
You are also obliged to use the Service in a way that does not hinder or interfere with its operation, such as by introducing malware, hacking, bypassing systems or protective measures.
We respect the rights of others, therefore it is forbidden to copy, distribute or any other use in whole or in fragments of information, data, photos or other content from the Domoteka Marketplace Service, except in cases where the Owner of the Service has given written consent to do so, or such use is within the limits of permitted use specified by the provisions of the Law on Copyright and Related Rights.
10. When might it be impossible or difficult to use the Service?
The Website will be updated and changed to provide the best possible user experience. During the period of maintenance work, as well as increased load on the operation of the Service, interruptions and difficulties in the use of the Service are possible.
The Owner of the Domoteka Marketplace Service will make every effort to ensure that the Service and all services made available through it operate continuously without any disruptions, however, the Owner of the Service is not responsible for disruptions caused by force majeure or unauthorized interference by Users or third parties for whose actions it is not responsible.
11. Can I make a complaint?
The Owner of the Website accepts your reports regarding technical aspects of the Website’s operation at kontakt@domoteka.pl.
The complaint should include the exact details of the complainant (name, surname of the complainant, mailing address, e-mail address, the reason for the complaint and the demand the complainant is making).
The complainant will be notified of the outcome of the complaint within 14 days from the date of delivery of the complaint to the address specified above.
The Owner of the Website is not responsible for the complainant’s failure to provide his data correctly, making it impossible to respond to the complaint.
12. What can I report to the Service Owner and how can I contact him?
Every aspect of the Service’s operation is important to us, so you can submit any reports or information at kontakt@domoteka.pl.
13. When can the Regulations change and where can I find their content?
You can find the regulations and amendments to them at: https://domoteka.pl/content/3-regulamin
Amendments to the Regulations are possible only for good cause, in particular in view of changes in applicable laws, decisions of the court or competent authority, in a manner that allows Users to become familiar with the changes in advance.
The Owner of the Service will publish changes to the Terms and Conditions on the pages of the Domoteka Marketplace Service. Information on changes to the Regulations will be made available no later than 14 days prior to the introduction of the amended Regulations.
Upon publication of the amendments to the Terms and Conditions, all previous provisions in the given indicated scope shall cease to be valid, and the new provisions shall take their place, unless further provisions of these Terms and Conditions provide otherwise.
The regulations are effective as of September 26, 2022.
